IronClad Family Privacy Notice

 This Privacy Notice was reviewed and updated on December 12, 2022.

 

This Privacy Notice contains the statements that we need to legally make in order to comply with multiple laws and regulations, but beyond those laws and regulations, we want to make a statement and a promise to you, our clients.

IronCladFamily believes in the absolute right of every person to control their personal information as if that information was a part of their physical body. That right of control includes the collection, storage, use, deletion, sale, or any other possible action that could be taken with their personal information.  IronCladFamily will comply with all laws regarding your personal information and will go above and beyond those laws if necessary to ensure that you have complete control over your personal information.

Our promise to you: We will be as transparent as possible with you regarding your information. You have the ultimate right to determine any collection or use of your information and IronCladFamily will respect that right. We will never sell your information. We will work with you in any manner possible to ensure that you have the information you need regarding your rights and will respect your complete and unlimited right to your own information.

 1.       Legal Preamble

This Privacy Notice provides our policies and procedures for collecting, using, and disclosing your information. Users may be able to access the IronCladFamily service (the “Service”) via our website www.IronCladFamily.com, via applications on Devices, via APIs, and via third parties. A “Device” is any computer used to access the IronCladFamily Service, including without limitation a desktop, laptop, mobile phone, tablet, or other consumer electronic device. This Privacy Notice governs your access of the IronCladFamily Service, regardless of how you access it, and by using our Services you consent to the collection, transfer, processing, storage, disclosure and other uses described in this Privacy Notice. All of the different forms of data, content, and information described below are collectively referred to as “information.”

 2.       The Information We Collect and Store

We may collect, process, and store the following information when running the IronCladFamily Service:

Information You Provide. When you register an account, we collect the personal information that you provide to us, including, but not limited to: your name, phone number, credit card or other billing information, email address and physical addresses. 

Files. We collect and store the files you upload, download, or access with the IronCladFamily Service (“Files”).

Log Data. When you use the Service, we may automatically record information from your Device, its software, and your activity using the Services. This may include the Device’s Internet Protocol (“IP”) address, browser type, the web page visited before you came to our website, information you search for on our website, locale preferences, identification numbers associated with your Devices, your mobile carrier, date and time stamps associated with transactions, system configuration information, metadata concerning your Files, and other interactions with the Service.

Cookies. To make this site work properly, we sometimes place small data files called cookies on your device. We alert you of this when you first access the IronCladFamily website and you need to actively allow us to use cookies before we will use them.

What are cookies?
A cookie is a small text file that a website saves on your computer or mobile device when you visit the site. It enables the website to remember your actions and preferences (such as login, language, font size and other display preferences) over a period of time, so you don’t have to keep re-entering them whenever you come back to the site or browse from one page to another.

 How do we use cookies?
We may use “cookies” to collect information and improve our Services. A cookie is a small data file that we transfer to your Device. We do not use “persistent cookies” to save your registration ID and login password for future logins to the Service. We may use “session ID cookies” to enable certain features of the Service, to better understand how you interact with the Service and to monitor aggregate usage and web traffic routing on the Service. You can instruct your browser, by changing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. If you do not accept cookies, however, you may not be able to use all aspects of the Service.

How to control cookies
You can control and/or delete cookies as you wish – for details, see aboutcookies.org. You can delete all cookies that are already on your computer and you can set most browsers to prevent them from being placed. If you do this, however, you may have to manually adjust some preferences every time you visit a site and some services and functionalities may not work.

Email.  The email address you provide, may be used to send you information and updates pertaining to your order or subscription. In addition we may send you periodic company news, updates, and/or related product or service information. If you do not wish to receive periodic updates, you may opt-out by following the unsubscribe instructions on the email you receive or contact us as described below.

3.       How We Use Personal Information

Personal Information. In the course of using the Service, we may collect personal information that can be used to contact or identify you or your recipient (“Personal Information”). Personal Information is or may be used: (i) to provide and improve our Service, (ii) to administer your use of the Service, (iii) to better understand your needs and interests, (iv) to personalize and improve your experience, and (v) to provide or offer software updates and product announcements. If you no longer wish to receive communications from us, please follow the “unsubscribe” instructions provided in any of those communications or contact us as described below.

Geo-Location Information. Some Devices allow applications to access real-time location-based information (for example, GPS).  Also, some of the information we collect from a Device, for example IP address, can sometimes be used to approximate a Device’s location.

Analytics. We also collect some information (ourselves or using third party services) using logging and cookies, such as IP address, which can sometimes be correlated with Personal Information. We use this information for the above purposes and to monitor and analyze use of the Service, for the Service’s technical administration, to increase our Service’s functionality and user-friendliness, and to verify users have the authorization needed for the Service to process their requests.

Payment Information. For your safety and protection, your credit card information is not stored on our servers. Our payment gateway provider keeps this information encrypted and secure on your behalf.

4.       Information Sharing and Disclosure

Your Use. We will display your Personal Information in your profile page and elsewhere on the Service according to the preferences you set in your account. Your Personal information, whether public or private, will not be sold, exchanged, transferred, or given to any other company for any reason whatsoever, without your consent, other than for the express purpose of delivering the purchased product or service requested by the customer.

Service Providers, Business Partners and Others. We may use certain trusted third-party companies and individuals to help us provide, analyze, and improve the Service (including but not limited to data storage, maintenance services, database management, web analytics, payment processing, and improvement of the Service’s features). These third parties may have access to your information only for purposes of performing these tasks on our behalf and under obligations similar to those in this Privacy Notice.

Legal Compliance. We may disclose to parties outside IronCladFamily files stored in your IronCladFamily vault and information about you that we collect when we have a good faith belief that disclosure is reasonably necessary to (a) comply with a law, regulation or compulsory legal request; (b) protect the safety of any person from death or serious bodily injury; (c) prevent fraud or abuse of IronCladFamily or its users; or (d) to protect IronCladFamily’s property rights. If we provide your IronCladFamily files to a law enforcement agency as set forth above, we will remove IronCladFamily’s encryption from the files before providing them to law enforcement to the limit of our ability. However, IronCladFamily will not be able to decrypt any files that you encrypted using shared secrets prior to storing them on IronCladFamily.  Unless prohibited by law, IronCladFamily will notify you as soon as possible if compelled to release your information to any third party or government agency.

Business Transfers. If we are involved in a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred as part of that transaction, but we will notify you (for example, via email and/or a prominent notice on our website) of any change in control or use of your Personal Information or Files, or if either become subject to a different Privacy Notice. We will also notify you of choices you may have regarding the information.

Non-private or Non-Personal Information. We may disclose your non-private, aggregated, or otherwise non-personal information, such as usage statistics of our Service.

5.       Changing or Deleting Your Information

If you are a registered user, you may review, update, correct or delete the Personal Information provided in your registration or account profile by changing your “My Account” settings. If your personally identifiable information changes, or if you no longer desire our services, you may update or delete your information by making the change on your “My Account” Settings. 6.       Data Retention

We will retain your information for as long as your account is active or as needed to provide you services. If you wish to cancel your account or request that we no longer use your information to provide you services, you may delete your account. We may retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Consistent with these requirements, we will try to delete your information quickly upon request. Please note, however, that there might be latency in deleting information from our servers and backed-up versions might exist after deletion.

7.       Security

The security of your information is important to us. When you enter sensitive information (such as a credit card number) on our order forms, we encrypt the transmission of that information using secure socket layer technology (SSL).

We follow generally accepted standards to protect the information submitted to us, both during transmission and once we receive it. No method of electronic transmission or storage is 100% secure however, and we cannot guarantee its absolute security. 8.       Our Policy towards Children

Our Services are not directed to persons under 18. We do not knowingly collect personally identifiable information from children under 18 other than from a parent or guardian. If a parent or guardian becomes aware that his or her child has provided us with Personal Information without their consent, he or she should contact us at admin@IronCladFamily.com. We comply with the Children’s Online Privacy and Protection Act (COPPA). If we become aware that a child under 13 has provided us with Personal Information, we will take steps to delete such information from our files.

10.   Changes to our Privacy Notice

This Privacy Notice may change from time to time. If we make a change to this Privacy Notice that we believe materially reduces your rights, we will provide you with notice (for example, by email). And we may provide notice of changes in other circumstances as well. By continuing to use the Service after those changes become effective, you agree to be bound by the revised Privacy Notice.

11.   Your privacy rights.

The California Consumer Privacy Act (CCPA) grants California consumers special rights.  Other states may have similar legislation granting rights to individuals not covered by the CCPA.  IronCladFamily, to the greatest extent possible, recognizes an individual’s absolute right to control their personal information and will comply with, or exceed, the most stringent legislation.  Specifically:

11.1.  You have the right to know which personal information is being collected.

IronCladFamily collects only that information that is necessary to perform the services which IronCladFamily offers. All collected information is input by the subscriber with no additional personal information collected by IronCladFamily in the background other than information such as IP address as described above. By entering the information, the subscriber acknowledges IronCladFamily’s right to retain this data.

11.2.   The right to know if personal data is being sold or shared, and to whom.

IronCladFamily does not sell information of any kind to any individual, firm, or government agency. If a subscriber chooses to use IronCladFamily’s “Delegate” function, then all information input by the subscriber may be visible to their designated delegate as if the delegate were the subscriber themselves. The subscriber acknowledges this and gives IronCladFamily permission to share that data with their delegate.

11.3.                     The right to object to the sale of personal data.

IronCladFamily does not sell any personal data.

11.4.    The right to access one's own personal information.

Any subscriber can access their personal data at any time and may make additions to their information or correct any of their personal information. Subscribers may also delete any information they desire to delete, but deletion of some information may compromise IronCladFamily’s ability to perform its services. The subscriber acknowledges their right to add, edit, or delete information and likewise acknowledges that deletion of some data might degrade the IronCladFamily services they are receiving.

11.5.   The right to equal service and price

No IronCladFamily subscriber will receive different or degraded services based solely on the exercising of their privacy rights.

11.6.  The right to opt-out of any communication.

Any individual my opt-out of receiving notices or emails from IronCladFamily at any by following the opt-out instructions on an email that they received or by contacting us directly at the email or phone number above or by messaging us via our chat service on the IronCladFamily website.
